Umalayitsha assaults wife over phone

IN a fit of jealousy, a Bulawayo cross-border transporter popularly known as malayitsha, who suspected his wife of infidelity, after he found a male contact saved in her mobile phone severely assaulted her leading her to sustain injuries all over the body.

Thokozani Ndlovu claimed she was forced to endure a tough time after her husband, Francis Ndlovu, physically abused her while trawling her phone, looking for evidence of infidelity.

She said her marriage had been punctuated by episodes of verbal, emotional and physical violence perpetrated against her by her husband.

So nasty are the abuse episodes that she approached the Bulawayo Civil Court seeking a restraining order against him.

In her documents, Thokozani said her husband had been physically, emotionally and verbally abusing her while accusing her of engaging in extra-marital affairs.

“The respondent is my husband and we are married in terms of Chapter 5:11 and the marriage still subsists. We have marital problems because of his extra-marital affairs which caused him to neglect his family.

“Besides the marital problems that we have, he has always been abusive towards me. He is physically abusive in that he always hits me whenever he feels like it.

“He is also verbally abusing me all the time and in front of the children.

“He has a tendency of insulting me while accusing me of having extra-marital relations.

“He uses those allegations as a reason to physically and verbally abuse me. He is always accusing me of being a prostitute and of bringing men to our home,” complained Thokozani.

She said she was now living in fear after her husband threatened to kill her.

“He has also threatened to kill me and as it stands, I now live in fear that at any point I will lose my life. Sometime in July in 2018 he physically abused me to the point that I ended up in hospital. He, however, did not stop the abuse.

“On 14 June this year he took my phone and interrogated me over a (male) contact number that was saved in the phone. He insulted me and labelled me a prostitute.

“He hit me on the back, thighs and all over my body. He has physically abused me for too long and I am afraid that the abuse will eventually lead to my death and even of those children that I live with.

“He has also threatened that I will one day be a victim, of what I have read in the newspapers pertaining to women being murdered,” said a disturbed Thokozani.

She further said she had no other way to protect herself and the children that she is taking care of.

“The respondent has left me with no choice but to approach the court to seek its intervention. I am seeking the court to grant an order that I stay at our homestead in Shangani while he resides at our house in Nkulumane 12, Bulawayo,” pleaded Thokozani.

In his response, Francis was not opposed to his wife’s request.

“I am not opposed to her application,” he tersely said.

In her ruling the presiding magistrate Nomasiko Ndlovu prohibited Francis from physically, verbally and emotionally abusing his wife as well as visiting their rural home where she lives.
