A 14-year-old Form Two pupil from Zvishavane has been arraigned in court for sodomising two minors aged five and six.
The boy pleaded guilty when he appeared before Zvishavane magistrate Mr Archie Wochiunga facing two counts of indecent assault.
In his mitigation statement, the minor told the court that he had seen the act on his brother’s phone and decided to imitate.
Passing sentence, magistrate Wochiunga said the accused’s overzealous behaviour could not go without punishment, as his action could have dire consequences on the two complainants. “This court finds you guilty as charged and you committed a serious crime which can’t go unpunished. Your actions could have serious consequences on the life of these young boys, therefore, the punishment of three strokes administered with a rattan cane is suitable for you,” he said. It was heard in court that on a day not known to the prosecutor but in January, the teen sucked the first complainant’s private part without his consent.
After sucking, he went on to sodomise the complainant, and instructed him not to report the matter to anyone.
On a different day, the teen approached the second complainant who was playing with his friends and asked to be accompanied to a nearby bush.
The accused led the second complainant to a bush where he sucked his private part, before threatening him with death, if he disclosed the matter to anyone.
On a different day, the teen fondled the second complainant’s private part before sodomising him.
The two minors told their parents about the incidents and the matter was reported to Zvishavane ZRP, leading to the teen’s arrest. Mr Tinashe Maponde prosecuted.
