Ex-Bulawayo councillor in trouble over missing ladder

Or if whatever you borrow breaks or tears, make a sincere apology and go and buy the person a new one if it can’t be fixed.

Former MDC-T councillor for Ward 29 in Cowdray Park, Bulawayo, Collet Ndhlovu found out the hard way that his actions amounted to theft after he was successfully sued by Robert Mlilo from Gwabalanda suburb after he failed to return a six-step ladder that he had borrowed from him.

Mlilo, who apparently wondered whether he may ever receive his ladder back, filed a class action lawsuit at the Bulawayo Civil Court demanding $7 797 from Ndhlovu being replacement value of his six-step ladder.

In his papers Mlilo stated that despite numerous demands, Ndhlovu who is also proprietor of Mahweba Sports Bar and Butchery in Cowdray Park suburb refused or failed to replace his ladder which he borrowed in February last year.

“Plaintiff claim against defendant is for the payment of $7 797 being replacement value of a six-step ladder that the plaintiff lent to the defendant in February 2019 at the latter’s instance or its market value during time of payment. Defendant lost the said ladder and has despite demand failed to replace it,” Mlilo’s suit reads in part.

Ndhlovu who presumably had no intention to return the borrowed item, didn’t however, respond to Mlilo’s summons leading the magistrate to grant an order in favour of Mlilo in which he (Ndhlovu) was asked to pay $9 282, an amount which includes the value of the ladder and cost of suit.
